Costin Stan

Costin is an experienced Senior Associate, advising across the areas of civil and commercial litigation, property law, wills and estates, family law and trusts.

With a law and finance degrees, Costin has both the legal knowledge and financial acumen to provide commercial advice to his clients ranging from property owners, real estate agents and brokers through to SMEs.

Costin has a strong foundation in commercial litigation disputes, including the interpretation of transaction documents; particularly relating to property law and finance issues.

Working under the guidance of Principal, Peter Jackson, Costin is experienced managing Court matters, including preparing evidence to support claims and instructing Counsel at both interlocutory and final hearings. He is admitted to the High Court of Australia and the Supreme Court of New South Wales.

Background

Prior to joining FCW Lawyers, Costin began his legal career in 2015 as a law clerk with Peter Jackson of Jackson & Associates, working his way up to the position of Associate before the firm merged with FCW Lawyers in September 2022.

Experience

Civil and Commercial Litigation

  • Reviewing and interpretation of commercial transaction documents between parties.
  • Acting for clients in disputed money claims in equity and common law, which includes breach of trust, breach of contracts and other causes of action.

Property Law

  • Acting for clients on the interpretation and enforceability of caveat clauses, removal of caveats, priority disputes and entitlements to payment of money held in court.
  • Acting in conveyancing property (commercial and residential) transfer matters, both for the vendor and purchaser, including advising on call option deeds and lease agreements.
  • Acting for lenders in loan transactions, including the preparation of loan and security documentation.

Wills and Estates

  • Advising on testamentary arrangements Including in cases involving complex business enterprises and children.
  • Advising an executor in a multimillion-dollar estate, including six separate family provision claims and reseal of Probate applications.

Family Law

  • Advising clients on applications for the alteration and division of property interests in the Family Court, including acting as junior counsel.
  • Advising clients in respect of Binding Financial Agreements.
Qualifications
  • Admitted as a solicitor of the High Court of Australia in 2020.
  • Admitted as a solicitor of the Supreme Court of NSW in 2019.
