Costin Stan

Costin is an experienced Senior Associate, advising across the areas of civil and commercial litigation, alternative dispute resolution, unconscionable actions, contested estates and property disputes.

With a law and finance degrees, Costin has both the legal knowledge and financial acumen to provide commercial advice to his clients ranging from property owners, brokers and SMEs.

Costin has a strong foundation in commercial litigation disputes, including the interpretation of transaction documents; particularly relating to property dealings, service agreements and finance issues.

Working under the guidance of Principal, Peter Jackson, Costin is experienced managing Court matters, including preparing evidence to support claims and instructing Counsel at both interlocutory and final hearings. He is admitted to the High Court of Australia and the Supreme Court of New South Wales.

Background

Prior to joining FCW Lawyers, Costin began his legal career in 2015 as a law clerk with Peter Jackson of Jackson & Associates, working his way up to the position of Associate before the firm merged with FCW Lawyers in September 2022.

Experience

Civil and Commercial Litigation

  • Reviewing and interpretation of commercial transaction documents between parties relating to call option deeds, loan agreements, service agreements and partnership agreements.
  • Acting for clients in a variety of disputes relating to informal contracts, breach of contract, negligence, promissory estoppel, unconscionable conduct, misleading and deceptive conduct.
  • Enforcement of judgements.

Property Law

  • Acting for clients on the interpretation and enforceability of caveat clauses, removal of caveats, priority disputes and entitlements to payment of money held in court.
  • Acting for both vendors and purchaser in respect of commercial and residential property transfers.
  • Advising on call option deeds and lease agreements.
  • Acting for lenders in loan transactions, including the preparation of loan and security documentation.

Wills and Estates

  • Advising on testamentary arrangements, including in cases involving complex business enterprises and children.
  • Advising executors in administration of multimillion-dollar estates.
  • Removal of executors for breaches of duties.
  • Pursuing and defending family provision claims.
Qualifications
  • Admitted as a solicitor of the High Court of Australia in 2020.
  • Admitted as a solicitor of the Supreme Court of NSW in 2019.
  • Bachelor of Laws, University of Notre Dame, Sydney (2017).
  • Bachelor Degree in Finance Banking and Accounting, Christian University ‘Dimitrie Cantemir’ Bucharest, Romania (2012).
