Dr Michael Schaper’s independent review of the Franchising Code of Conduct

In our second video in the automotive series, FCW’s Senior Consultant Sotheary Bryant and Peter van Rompaey discuss recommendations 4, 23, 8 and 9 from Dr Michael Schaper’s independent review of the Franchising Code of Conduct.

These recommendations are:

  • Recommendation 4: the Code be extended to explicitly capture service and repair work carried out by motor vehicle dealers.
  • Recommendation 23: the implications of a future licensing regime in the motor vehicle industry. And specifically exploring, the outsourcing of the licensing scheme to an ‘AFCA like’ body.
  • Recommendations 8 and 9: refers to Clauses 46A and 46B of the Code, contained in Part 5, which only apply to new vehicle dealers. We identify the limitations of clauses 46A and 46B and explore how dealers can use these clauses to their advantage.
